Comprehensive Immigration Reform Bill NAAIIP represents over approximately 90,000 small business organization in US which roughly covers of population of 1.5 million IT Professionals with in our community in US. Most of them arrived in US through work visa such as H1B, L, and or Student Visa
We are presenting 14 top proposals. A quick summary of these proposals are enclosing for your review.
LIST OF PROPOSALS
Exempt small business high tech IT companies from maintaining 50:50 ratio
In industry where there is an acute shortage of high tech, it will be impossible to have 50 % citizens. Many positions remain unfilled. Only big companies are able to attract those available resources and making it harder for small high tech companies. This will put undue pressure on small companies to survive to meet impossible task when there is already a shortage of talent resources in country. Therefore we request to exempt this provision for smaller companies from this provision where shortage is recognized as acute by DOL. This will ensure the level playing field.
Eliminate Country wise Quota
The existing 7% of country quota of Green Card Visa allocation is unfair and delay process for countries like India up to 10-20 years. This will discourage talent retention in US & may speed up reverse brain drain. The criteria should be First-come, first-served (FCFS) basis because our objective is attract the best and brightest from any part of the world.
Employment based green cards to be given only for employment purpose
Currently Employee?s dependents are counted against the Employment visa quota. They should be counted towards the dependent visa (not the employment visa) to be applied only to employment purpose of main beneficiary of petitioner. Rest of dependent family members should get family green card visa without any restriction on count. We propose to create a new category of ?Dependents? similar to H4 Dependents.
Introduce Entrepreneur Visa
A new category of ?Entrepreneur Visa? will encourage best & bright people to start companies with low capital without looking at opportunities in other countries. Eligibility for such visa should include from H1B and F visa category. This will definitely open up the opportunity from the countries where E Visa Treaty is not signed.
Training
Creating future work force should be responsibility of not only Universities but also Employers. Bigger companies have the infrastructure and should take the higher responsibility where there is an acute shortage of resources. This can be achieved by linking number of H1B visa can be requested by companies to the amount of money spent on training, upgrading skills of US residents including creating entry path to job market for students in US. Big companies have conveniently avoided this responsibility resulting into mass outsourcing of US jobs to lower wage countries, thus profiting enormously at back of US workers and great loss to US economy. If this practice practices continues, which will compromise our leadership in technology research & innovation in the future global market?
